Mr Khairil admitted a breach of rule 520(4)(c) in race 6 in that he failed to make the weight for MAGIC MAN by being unable to claim down to his agreed riding weight of 53.5 kg.

Mr Ching outlined the circumstances of the matter and indicated that Mr Khairil was replaced on MAGIC MAN by another apprentice. He stated he was concerned that "a trend" was developing in that Mr Khairil had had been fined $300 and replaced on his mount at Winton on 21 September last when overweight and he had been suspended for a similar breach at the previous meeting.

Having regard to Mr Khairil’s record and his admission of the breach, we agree that a suspension is appropriate in this instance. This breach has occurred despite an agreement reached at Omakau on 30 December that he be able to ride at 53.5 kg. In fact, he was only able to ride at ¾ over this agreed weight. The consequence was that he had to be replaced on MAGIC MAN. Mr Khairil has 2 previous breaches of this rule: one in September 2007; and another at the previous South Island meeting.

Mr Ching has asked for 4 to 6 days suspension. Mr Hamilton on Mr Khairil’s behalf has asked for a lesser penalty. There has to be a deterrent element to this penalty as the previous penalties, plus the agreement with Mr Ching, do not appear to have had the desired effect. We believe 4 days suspension to be appropriate. Mr Khairil is currently suspended until 5 January. He is further suspended from riding from 6 January up to and including 24 January 2008. This is 4 South Island days.
