Mr Moseley alleged that BELMONT CAT or its rider placed 3rd by the Judge interfered with the chances of MATAI TOM TOM placed 4th by the Judge. The interference occurred over the concluding stages. He asked for relegation in accordance with rule 876(1). Placings were 11, 1, 5, 8, 7, 6. The margin between 3rd and 4th was a neck.
----Mr Moseley demonstrated on the videos that there were 3 points of contact in the concluding stages of the race (approximately the last 150 metres). He had received 3 bumps, he said, and had had to put the stick away after the second bump. MATAI TOM TOM had become quite unbalanced, particularly when bumped for the third time when it had been forced out onto the horse on his outer, MONEY MAN.
----Mr Daly stated that MATAI TOM TOM was not making ground on BELMONT CAT, which in his view was finishing the better of the 2 horses. He said even with a clear run MATAI TOM TOM would not have beaten BELMONT CAT. Mr Bates stated his horse was as unbalanced as MATAI TOM TOM due to the contact and pointed out that MONEY MAN was laying in at the time of the third incident.
----Mr Ching, when asked to comment, said there were 2 points of contact of note. MATAI TOM TOM had been bumped from the inside and forced out onto MONEY MAN. MATAI TOM TOM had become unbalanced as a consequence in the run to the line.
----We are satisfied that there were 3 points of contact as Mr Moseley alleges. However, we are of the view that only the latter two resulted in interference to MATAI TOM TOM. The source of this interference was outwards movement by BELMONT CAT when Mr Bates was seeking to take a gap that had briefly presented itself and when that horse was inclined to race greenly. We agree that BELMONT CAT was finishing well, but in endeavouring to obtain a run that horse had moved outwards and come into repeated contact with MATAI TOM TOM. That BELMONT CAT had become unbalanced, as Mr Bates alleges, was due to the fact that it had come into contact with MATAI TOM TOM, not vice versa, and any inwards movement from MONEY MAN was due to the buffeting that horse had received as a consequence of MATAI TOM TOM being forced outwards.
----In exercising our discretion and determining to relegate BELMONT CAT to behind MATAI TOM TOM we take into account that the interference was at a crucial stage of the race, Mr Moseley had to stop riding with the stick and MATAI TOM TOM had become unbalanced as it was forced outwards as a result of the 2 quite distinct bumps it received from BELMONT CAT, and the margin was only a neck. Amended placings are 11, 1, 8, 5, 7, 6.
