Mr Laking you?ve admitted a breach of Rule 520(4)(c) in that you failed to make the contracted weight for CHINA ROSE in Race 1 and PENNY PARKER in race 6.
Mr Laking you?ve admitted a breach of Rule 520(4)(c) in that you failed to make the contracted weight for CHINA ROSE in Race 1 and PENNY PARKER in race 6. We thus find the charges proved. When you were weighed at the commencement of the meeting you were 57 kg. You were carded to ride CHINA ROSE and PENNY PARKER at 55.5 kg.
----This is your second such breach of the rule this month and the 5th weight related matter this past year, including 2 breaches at Cromwell. As we have discussed with you on previous occasions you have an ongoing difficulty with your weight which we accept you are doing your conscientious best to address. We are concerned that a lengthy suspension will not assist with your dealing with this issue and Mr Ching does not disagree. He has asked for a suspension and said if the Committee believes a fine to be appropriate it has to be substantial, in the range of $500 to $1000.
----In mitigation is your ready admission of the breach, your immediate notification of the matter to the stipendiary stewards, your honesty in the Judicial Room, and the fact that the diuretic you have come to rely on to lose a kg or so is from today no longer an option for you as it is now a banned substance under the Rules of Racing.
----As we have said, we don?t believe a lengthy suspension is the answer but there has to be a deterrent element to the penalty. The next meeting is at Omakau where 14 races are intended to be raced. You have said this should equate to 2 days. We accept it equates to close to 2 days. We suspend you from the end of racing today up to and including Thursday 4 January and you are fined the sum of $350.
----Mr Ching has raised the possibility of NZTR being proactive with respect to your weight issue. We would support any steps that may be able to be taken in this regard.
