Decision:
We rule that WANDERING STAR and PICKETTS RIDGE should be disqualified from the race and deemed to be scratched. We advise the Stewards accordingly.
Facts:
Following the running of race 7, the GOLDEN FLEECE HOTEL / SPEIGHTS BREWERIES TROT, Mr Tidmarsh lodged an information seeking a ruling to determine whether WANDERING STAR (S O’Reilly) and PICKETTS RIDGE (N Williamson) should be disqualified and scratched from the race.
WANDERING STAR finished 12th and PICKETTS RIDGE finished 5th.
Rule 862(3) provides as follows:
When a horse starts in advance of its mark or correct barrier position, in addition to any other penalty that may be imposed, the horse shall be disqualified and deemed to be scratched from the race.
Submissions for Decision:
Mr Tidmarsh demonstrated on the videos that the two horses in question started from the two outside positions on the front line. He said this was at the instruction of the starter. He explained that there were two late scratchings and the two horses had erroneously been advanced to the front line, whereas they should have started on the second line near the markers.
Mr Williamson said he asked the starter whether he should stay on the 2nd line and he was told that he and Ms O’Reilly were to start from the outside of the front line. He was surprised by this but did not question it. He said he did not believe he had obtained any advantage as his horse had broken at the start. Ms O’Reilly did not believe her chances had been affected.
Reasons for Decision:
The rule is clear if a horse start in advance of its correct barrier position the horse shall be disqualified and deemed to be scratched from the race. There is no discretion vested in the Committee. Fortunately, neither horse was placed in a dividend bearing position, so the issue does not arise of our decision directly affecting stakes or dividends. However, the pool is reduced with a resulting loss for the Club, and the dividends for those persons who invested on the placed horses are also reduced, as there are two less horses in the field. The connections of the horses are also denied the payment that is available for unplaced runners.
We note also, of course, that those persons who placed investments on the two horses did so in the anticipation they would start from their correct marks, ie the second line, near the markers. They did not.
