Rule  869 (2) (a) : Mr Knowles, Stipendiary Steward, alleged that Mr G Hunt (DEL’S HOOF N IT) used his whip in an excessive manner inside the final 400 metres.

Mr Knowles had Mr Allison, Assistant Stipendiary Steward, demonstrate on the video that Mr Hunt used the whip continuously on DEL’S HOOF N IT over the final 400 metres. In our presence, he counted 27 or 28 strikes. He said the continuous use was in breach of the guidelines that required there to be distinct pauses.

Mr Hunt stated he was unaware of the guidelines but accepted that he had continuously used the whip over a distance he alleged to be 350 metres.  He therefore admitted the breach part way through the hearing.

Mr Knowles stated Mr Hunt had no breaches of this rule in the past 12 months and asked for a fine in the range of $200 to $250.

Mr Hunt suggested a fine of $150.  He said he had never been in breach of this rule before.  He said he believed that DEL’S HOOF N IT had not tried at its previous start and this might account for why he was more aggressive than usual on this occasion.

We count 27 strikes with the whip in a continuous fashion over a distance of 350 metres. We take into account Mr Hunt’s very good record with respect to this rule and his eventual admission of the breach. He is fined the sum of $200 and reminded of his obligations under the Rules of Harness Racing.
