We dismiss the charge.

Charge:

Mr McIntyre alleged that Mr Orange (JANE CATHERINE) drove in a manner causing interference to CHRISTIAN’S BLUE LADY when he allowed his horse to drift out with 400 metres to run, which in turn caused interference to JASPER MAGUIRE.

Facts:

Mr McIntyre had Mr Renault demonstrate on the videos that Mr Orange drifted out 1 to 1 1/2 horse widths with some 400 to 500 metres to race.

Submissions for Decision:

Mr McIntyre said at the time Mr Orange and Mr Close locked wheels Mr Close had no where to go.
Mr Orange and Mr O’Reilly both stated that Mr Close was an inexperienced driver and should have missed Mr Orange. 

Reasons for Decision:

We accept that Mr Orange and Mr Close were racing in tight quarters shortly after turning for home.  As a consequence the wheels of their carts came into contact and locked briefly.

We accept the defendant was endeavouring to nurse the horse at a critical stage of the race. Of concern to us are the actions he has taken after the horse straightens and when the horse continues to drift out.

Mr McIntyre said Mr Orange should have driven with more strength in the left hand rein. Mr Orange said his experience suggested to him to tap the horse lightly with the right hand and to jerk the left hand rein a little.

However, on this occasion we give the benefit of the doubt to the defendant that he was aware he was drifting out and was endeavouring to control his horse. That his horse’s head was angled inwards immediately prior to the locking of wheels has led us to conclude there was little else he could have done in respect of a horse that he has told this committee was not responding and was a spent force.
