Facts:

Mr McIntyre alleged that after approximately 100 metres BERKSHIRE SON (No 7) broke checking BIG MAC D (No 4), which broke losing considerable ground.

Submissions for Decision:

Mr McIntyre demonstrated that BERKSHIRE SON was making an angled run to the rail to take a trailing position when that horse broke. He said the horse appeared to resent its driver, Ms Laing, trying to pull up the horse and Mr Crawford was left with not a lot of room to move on its inside.

Mr Crawford who was racing immediately behind Ms Laing attempted to move on the inside of BERKSHIRE SON. In so doing, Mr Crawford had to take hold of BIG MAC D, which appeared to baulk at the galloping BERKSHIRE SON. The consequence was that BIG MAC D galloped and by the time Mr Crawford was able to return the horse to its correct gait it was some 50 metres behind BERKSHIRE SON, which had settled back into a gait shortly after it had broken.

The driver of BERKSHIRE SON, Ms Laing, said she took corrective action but there was some hesitation on the horse’s part before it straightened. Ms Laing did not believe that the horse was hanging but had had inwards momentum and simply had “taken a bit to come out”. She thought there was time for Mr Crawford to have moved through on her inner without breaking.

When questioned by this committee, Mr Crawford was adamant that his horse would not have broken had BERKSHIRE SON not galloped in front of him. We were concerned that Mr Crawford had had some 4 strides to take evasive action but accept that BERKSHIRE SON had not moved wider on the track as quickly as Mr Crawford would have expected.

Reasons for Decision:

In exercising our discretion to relegate BERKSHIRE LAD we are satisfied that BIG MAC D suffered interference shortly after the start and that the cause of that interference was the galloping BERKSHIRE SON. BIG MAC D galloped and lost considerable ground. That horse’s chances and progress were clearly affected.
