Ms Young has admitted the breach. The charge is proved.

Ms Young is fined the sum of $300. The Stewards confirmed she had been reminded of her obligations under the Rules.

Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Ms Young (CLASINA MARIA) used her whip on more than 10 occasions inside the final 400 metres in race 9, the MORNINGTON TAVERN WAIKOUAITI CUP.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

The Use of Whip Guidelines (effective from 1 December 2016) provide:
The whip shall not be used more than 10 times in the last 400 metres of a race, otherwise this will be deemed excessive use pursuant to these Guidelines.

Mr Tidmarsh demonstrated on the videos that Ms Young, driving CLASINA MARIA, was racing 3 from the outside in the home straight and that she used her whip 12 times.

Ms Young admitted the breach and did not wish to be present as she was leaving the course.

Submissions for Penalty:

Mr Tidmarsh produced Ms Young’s record, which evidenced she had a breach of this rule in October last year. However, this was before the guidelines were introduced and Mr Tidmarsh indicated the RIU regarded this as a first breach. He said the strikes were too numerous. He agreed with the Committee that there was one pause in the respondent’s action and that there was one strike with the reins after the initial 3 strikes.

Reasons for Penalty:

The starting point is a fine of $500 as in the JCA Penalty Guide. Ms Young’s breach is towards the lower end. There are 12 strikes and CLASINA MARIA was responding to these. They were not forceful and there were two brief pauses. After credit of $100 for each of the mitigating factors of the admission of the breach and Ms Young’s good record, this results in a penalty of a fine of $300.
