Facts:
At the conclusion of Race 10, the STRATH TAIERI/BEAKS SHEEP HANDLING TROT, Mr Tidmarsh lodged an information under r 870(5) alleging HENGROEN was lapped on when galloping over the finishing line and was therefore subject to relegation to 6th placing.
Judge’s placings were:

The official margin between 4th and 5th was a nose and between 5th and 6th 1/2 a length.
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
Mr Tidmarsh demonstrated that HENGROEN galloped inside the final 50 metres when the removal deafeners were activated. He alleged HENGROEN was lapped on by DREAM BIG and PRINCE GEORGE when the horse crossed the line.
Mr Ydgren, Chief Stipendiary Steward, informed the Committee that Mr Norman, the trainer/driver of HENGROEN, had confirmed to him that he did not contest the protest.
Reasons for Decision:
The Committee is satisfied that HENGROEN galloped some 40 metres prior to the winning post and was not in its correct gait when it crossed the finishing line. The horse, which had not suffered interference from any other runner, was lapped on by DREAM BIG and PRINCE GEORGE.
