Mr Tidmarsh, Stipendiary Steward, alleged that Mr Frost (REDMARO) used his whip excessively throughout the final straight in race 1, the BISHOPDALE /BUSH INN TAB/TAVERN HAREWOOD MOBILE PACE.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
The Use of Whip Guidelines (effective from 1 December 2016) provide:
The whip shall not be used more than 10 times in the last 400 metres of a race, otherwise this will be deemed excessive use pursuant to these Guidelines.
Mr Tidmarsh demonstrated on the videos that Mr Frost, driving REDMARO, was towards the rear of the field as it came into the home straight and over the final 350 metres in the run home he used his whip 13 times.
Mr Frost said he was aware of the rule and with his horse responding to his use of the whip when he mounted a run to the outside of the field, he had overlooked the number of strikes.

Mr Tidmarsh produced Mr Frost’s record, which was clear under this rule, as this was the respondent’s first raceday drive. He said the strikes were not forceful but were too numerous. He agreed with the Committee that there was one pause in the respondent’s action.
Mr Frost asked that he be fined rather than suspended. He said he would learn from this experience.
