Following race five an information was filed pursuant to Rule 638(1)(d). The informant, Mr Oatham, alleged that Mr Calder permitted his mount HERECOMESTHECAT to shift inwards near the 800 metres when insufficiently clear of GENERAL GEORGI (J McDonald) who was checked.

DECISION & REASON:
Following race five an information was filed pursuant to Rule 638(1)(d). The informant, Mr Oatham, alleged that Mr Calder permitted his mount HERECOMESTHECAT to shift inwards near the 800 metres when insufficiently clear of GENERAL GEORGI (J McDonald) who was checked.
Mr Calder admitted the breach.
--Mr Williamson demonstrated the video films and pointed out to the Committee GENERAL GEORGI racing in a two off position approaching the 800 metres. HERECOMESTHECAT was racing ahead and on the outside of GENERAL GEORGI. The films then showed Mr Calder shift in to a two off position when only approximately one length clear of GENERAL GEORGI. This caused Mr McDonald to check his mount by taking a strong hold.
--Mr Calder told the Committee he had a look to see if he was clear to move in. He thought Mr McDonald was taking a hold to ease back, therefore leaving him enough room to move in. He said Mr McDonald’s mount was racing fiercely, but admitted he had made a mistake in not leaving Mr McDonald enough room.
--PENALTY SUBMISSIONS:
Mr Oatham said Mr Calder’s record was excellent with one suspension in the last 12 months – 13 February 2009 – five days. He said in this case there were some mitigating factors – namely that GENERAL GEORGI was over-racing. However, he said Mr Calder had come in when not the required distance clear. Mr Oatham said it was an error of judgement on Mr Calder’s part, but submitted it was at the bottom end of carelessness.
When asked Mr Calder said he had commitments up to 16 January 2010.
--PENALTY:
The Committee carefully considered all evidence and submissions. We agree that Mr Calder made the mistake of thinking Mr McDonald was easing back, therefore leaving him enough room to move in. It was clear on the film Mr Calder was not sufficiently clear when he elected to move in to a two off position.
The Committee believes, however, that this is a relatively minor breach of the rule, and accordingly impose a minimum term of suspension. This suspension on Mr Calder from riding in races is to start after racing on 16 January and concludes after racing on 25 January 2010 (four days).
