The protest was dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision.

Facts:

Following the running of race 6, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr J Bell, Trainer of ATA RANGI, alleged that IRON EAGLE or its rider placed 3rd by the Judge interfered with the chances of ATA RANGI placed 4th by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No. 9 LADY RUPOLPH
2nd No. 6 SHOW DOWN
3rd No. 7 IRON EAGLE
4th No. 2 ATA RANGI

The official margin between 3rd and 4th was 1 ¾ lengths.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

At the commencement of the hearing a protest lodged by Mr Bell 4th vs 1st was withdrawn.

Mr Bell submitted that IRON EAGLE shifted out into the running line of ATA RANGI near the 100 metres. He said that ATA RANGI ran on strongly when it got room and the protest was a “no brainer”.

Ms Thornton said that ATA RANGI was presented with a run near the 100 metres but there was movement from her inside and outside. She added the interference cost her mount winning the race.

Mr S McKay said that MAYBEASHOWOFF had shifted in and that is why ATA RANGI was checked. He added that when LADY RUDOLPH improved to his inside over the concluding stages that runner moved out into IRON EAGLE’s running line.

Mr Williamson on behalf of the Stewards said that the alleged incident occurred near the 125 metres. He said that MAYBEASHOWOFF moved in and tightened ATA RANGI. He said that passing the 100 metres IRON EAGLE continued on a straight line until LADY RUDOLPH improved to that runner's inside. As a result LADY RUDOLPH shifted out onto IRON EAGLE. In conclusion he submitted that the Stewards did not believe that IRON EAGLE caused interference to ATA RANGI.

Reasons for Decision:

The Committee carefully considered all of the submissions presented and reviewed the video footage.

In our assessment we found that near the 125 metres MAYBEASHOWOFF shifted in and as a result Ms Thornton had to take a hold of ATA RANGI when crowded for room. The video footage did not support Mr Bell’s assertion that IRON EAGLE caused interference to ATA RANGI. It was clear that MAYBEASHOWOFF caused interference to ATA RANGI.

Then inside the final 100 metres LADY RUDOLPH shifted out slightly into the running line of IRON EAGLE. As a consequence ATA RANGI became awkwardly placed on the heels of IRON EAGLE for a moment when travelling well.

In conclusion we were fully satisfied that IRON EAGLE did not cause interference to ATA RANGI. Consequently under the provisions of the Rule the protest was dismissed.
