As Mr Kozaki admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Kozaki ’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Kozaki’s license to ride in races is suspended for a period to commence after racing on 16 November and conclude after racing on 27 November 2019.

Facts:

Following the running of race 6, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Kozaki allowed his mount MATUZALEM to shift in when not sufficiently clear of APELLIDO which shifted in forcing MY SUPERIOR GIRL in crowding FIRODEN which was hampered and checked near the 1100 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Kozaki said that he understood the Rule and confirmed he admitted the breach.

Mr Yanagida supported Mr Kozaki at the hearing and spoke on his behalf.

Mr Jones demonstrated the incident using the available video footage. He identified that Mr Kozaki angled his mount in from a 4 to 5 wide position to a 3 wide position near the 1100 metres. He said the inward movement was not sharp but he slowly applied pressure to runners on his inside. He noted that the rider of FIRODEN lost her irons when checked and as a result that runner took no part in the race. He said that Mr Kozaki was ¾ of a length clear of APELLIDO when shifting in.

Mr Yanagida said that Mr Kozaki accepted Mr Jones’ interpretation of the incident. He said that Mr Kozaki tried to keep his mount straight but conceded that he was too late in taking any corrective action.

Submissions for Penalty:

Mr Williamson said that Mr Kozaki had a clear record from 15 NZ race day rides. He said the level of carelessness was low range but the consequences were higher.

Mr Yanagida advised that Mr Kozaki sought a 7 day deferment so could fulfil his engagements on 16 November.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video films the Committee deemed the level of carelessness displayed by Mr Kozaki was midrange. We found that 3 horses were checked to varying degrees with FIRODEN being the worst affected. FIRODEN was crowded for room adjacent to the rail, clipped a heel and blundered with Ms Fawcett losing the use of her stirrup irons. As a result the horses’ chances were extinguished.

The JCA Penalty Guide starting point for midrange carelessness is 8 national riding days which was adopted.

The mitigating factor was Mr Kozaki’s admission of the breach and he was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
