Following Race 5 an information was filed by Stipendiary Steward Mr J Oatham pursuant to Rule 871 (1) (d) when it was alleged that Mr T Russell committed a breach of the Rule in that leaving the straight on the first occasion T Russell, rider of CALATRAVA, permitted his mount to shift in when not clear of KEEPA CRUISIN dictating that runner inwards resulting in a check to LADY LUCILLE ridden by Ms L Cropp.

Mr Russell admitted the charge.

Stipendiary Steward Mr A Cole demonstrated the videos. He showed where, as the horses left the straight, Mr Russell allowed his mount to move across and put pressure on KEEPA CRUISIN who was forced in to the line of LADY LUCILLE who was checked. Mr Cole said there were mitigating circumstances in that Mr Innes had moved up on his inside.

As Mr Russell had pleaded guilty to the charge we are to adjudicate on penalty only.

Mr Oatham gave Mr Russell's good record. He also said that although there were mitigating circumstances Mr Russell had pleaded guilty as charged and the status of the race also had to be taken into account. He asked for a suspension of 4 - 6 days and fine of $400 - $600.

Mr Russell said that he felt that he was a little unlucky because of the riding of Mr L Innes when coming up on his inside.
