Facts:
Following the running of Race 6, the Dashtickets.Co.NZ 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Stipendiary Steward Mr J Oatham alleged that near the 800 metres Apprentice Rider Ms A Jones riding ONLYAROSE allowed her mount to shift in when not clear of FAR FETCHED (Mr M DuPlessis) which was checked.
Ms Jones was assisted at this hearing by Mrs K Fursdon, Licensed Trainer, to whom she is apprenticed.
Ms Jones acknowledged that she understood the nature of the charge and the Rule and that she admitted the breach.
Rule 638(1)(d) provides: 'A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless".
Stipendiary Steward Mr A Coles identified the subject horses on the available video films. He pointed out that near the 800 metres ONLYAROSE was outside and a bare length ahead of FAR FETCHED with CARTELL inside that horse. Mr Coles stated that Ms Jones allowed her mount to angle inwards when not clear of FAR FETCHED which put pressure on that horse, resulting in it clipping heels with CARTELL and blundering. Mr Du Plessis was forced to take a strong hold of his mount as a result. Mr Coles added that CARTELL had been over-racing at the time which may have been a contributing factor to this incident.
Ms Fursdon, for Ms Jones, acknowledged that she had erred in not allowing enough room between her mount and FAR FETCHED before making an inwards movement.
Submissions for Penalty:
Mr Oatham produced Ms Jones' riding record which showed that she has ridden in approximately 300 races during her career to date without appearing on any matter. He added that in the Steward's opinion she had an excellent record. It was to her credit that she had admitted this breach. Mr Oatham submitted that while the interference to FAR FETCHED was rather severe this was balanced by the mitigating circumstances referred to. He added that Ms Jones' carelessness was at the lower end of the scale, and that the Stewards felt any penalty could reflect that.
Ms Jones said she agreed with the submissions made by Mr Oatham. She added that she had a firm engagement for the horse SILK CHARDONNAY (trained by her employer Ms Fursdon) at Riccarton on Saturday 15th November and any suspension could start after that meeting.
Reasons for Penalty:
The Committee took into account all of the evidence and submissions made. We have adopted 5 days as the starting point in considering a term of suspension. The significant mitigating factors are Ms Jones' admission of the breach and her clear record to date considering she is a busy apprentice rider. This is a credit to her and her employer. We accept the submissions from Mr Oatham that this incident was not high on the level of seriousness although we record that as a result of it there was a protest lodged against CARTELL which had interfered with another horse following pressure from ONLYAROSE. That protest was unsuccessful.
After taking all of the above factors into account the Committee considers that an appropriate penalty is a suspension of Ms Jones' riding license for a period of 4 days.
