As Mr Bosson admitted the breach we find the charge proved.

Charge:
Following race 7, Munns The Man's Store / R M Williams 1600, an information was filed pursuant to Rule 330(3)(c). The Informant, Mr Oatham, alleged that Mr Bosson was unable to make the contracted weight on ANTONINE.
Mr Bosson acknowledged that he understood the nature of the charge and the Rule.
Rule 330(3)(c) states : A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry
Facts:
Mr Oatham informed the Committee that he first became aware that Mr Bosson may have trouble making the carded weight of 55kg when Mr Bosson's agent rang him at 9.30am this morning. Mr Cossey, the agent for Mr Bosson, told Mr Oatham that it would be touch and go as to whether Mr Bosson could make the weight on Antonine in race 7. However, Mr Cossey did state that Mr Bosson wished to come and fulfil his earlier rides to establish whether he could make the 55kgs. Mr Oatham further informed the Committee that the connections of Antonine were going to permit Mr Bosson to ride at 55.5kg.
Mr Oatham stated it became obvious after race 1 that Mr Bosson would not be able make the carded weight. The consequences of this were that Mr McCarroll, the trainer of Antonine, was not satisfied with the available replacement riders for his horse. This meant he advised the Stewards he wished to scratch Antonine from the race, which under the circumstances the Stewards accepted.
Mr Bosson submitted that he accepted all responsibility for his actions. He said he accepted the ride at 55.5kg, however he had been suffering from the flu all week and subsequently found the lightest he could get down to was 1kg over the carded weight.
Submissions for Penalty:
Mr Oatham produced Mr Bosson's record which showed 5 previous breaches under this rule in the last 12 months. He said he had some sympathy with Mr Bosson because there was always pressure on him to take mounts as the leading rider and also noted there was a lack of senior riders currently. The aggravating factors he said were Antonine was in a leg of the $200,000 pick 6 and a well fancied runner which meant the betting public and connections were adversely affected.
Mr Oatham informed Mr Bosson that any further breaches of this Rule would result in a suspension. He advised Mr Bosson that he and his agent must be more realistic in setting appropriate weights before committing to trainers especially in the winter. He submitted an appropriate penalty would be a fine in the range of $500 to $1,000.
Mr Bosson acknowledged that a fine was appropriate because a suspension would not help his weight in the winter.

The Committee carefully considered all the evidence and submissions presented. The mitigating fact was Mr Bosson's admission of the breach. The aggravating factors were this was Mr Bosson's 6th breach in the last 12 months, the betting public were disadvantaged today with Antonine involved in a $200,000 pick 6, Mr Bosson is the leading rider in the country, and the connections were let down by Mr Bosson being unable to make the carded weight for Antonine which resulted in the horse being late scratched.
The Committee told Mr Bosson that any further breach of this Rule would result in a suspension and he and his agent must be more vigilant in accepting appropriate mounts.
The JCA penalty listings confirmed that Mr Bosson received a $500 fine for this breach in January 2013.
After taking into account all the above factors we independently assess an appropriate penalty is a $800 fine.
