Accordingly, the Committee declared MATIMBA to be a non–starter.

Facts:

Following the running of Race 10, BDC Paints Premier, an Information was filed pursuant to Rule 632. The Informant, Mr J Oatham, Requested a Ruling as to whether the gate of MATIMBA was slow to open and therefore denied a fair start.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Oatham told the Committee that MATIMBA’s gate failed to open and the horse had to force its way out. He demonstrated on the head on film that all the other barriers had opened prior to MATIMBA’s. He pointed out that MATIMBA settled equal last and he submitted the horse was denied a fair start and was of the view MATIMBA should be declared a non-starter.

Mr Leung told the Committee that when the start was activated every other horse’s gate opened while his was still shut. He added that MATIMBA forced its gate open and the incident cost him 2 lengths.

Mr Darvill had nothing further to add.

Mr Moody told the Committee that the gate failed to open and noted MATIMBA had to force its way out of the barriers.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video films. It was clear MATIMBA’s gate was slow to open due to a mechanical failure of the starting stalls. We are satisfied this materially prejudiced the chances of MATIMBA. We believe the incident cost MATIMBA approximately 2 lengths.
