Decision:

The breach is admitted and therefore the charge is proved.

Penalty:

This Committee orders that Mr Ormsby's Licence to ride is suspended from the conclusion of racing today to the conclusion of racing on the 15th of October 2020. We have not taken into account the meeting at Hastings on the 8th of November 2020 because Riders have already been declared for that meeting.

The suspension therefore is one of 5 National Riding Days.

Facts:

Following the running of the BEEFEATER GARDEN BAR 1200 an Information was lodged by Stipendiary Steward Mr B Jones against Jockey Mr C Ormsby  alleging that Mr Ormsby as the Rider of VIKING permitted his mount to shift in near the 900 metres mark when insufficiently clear of KEKE STAR (Rider Ms S Collett) which was checked.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Ormsby was present at the Hearing and advised the Committee that he understood the Rule and that he admitted the breach.

Senior Stipendiary Steward Mr M Williamson demonstrated the incident by use of the race films. He showed where VIKING drew wide and was about 6 horse widths wider than KEKE STAR. Shortly after the start Mr Ormsby began to move inwards and in doing so he moved his horse in several horse widths and into the line of KEKE STAR which was checked.

Mr Ormsby acknowledged his inwards movement and the check to Ms Collett's horse. He said " I got it wrong by about 2 strides".

Submissions for Penalty:

Mr Jones referred to Mr Ormsby's record and said he had one breach of this Rule in the past 12 months that being on the 17th of September when he received a 3 day suspension.

He said that as far as the incident was concerned the Stewards believed that it was low to mid range.

Mr Ormsby said that it was low range and that the affected horse hadn't lost the position that its Rider wanted to be in.

Mr Ormsby was offered a deferment of his suspension but he said he would like to take it straight away.

Reasons for Penalty:

The Committee reviewed the films. This is in our opinion a low range incident. Mr Ormsby has certainly come in a number of horse widths and in doing so he has brushed against Ms Collett's horse but he has checked that horse. We agree that he hasn't affected the position that Ms Collett wanted to be in.

The starting point penalty in the JCA Guidelines for a low range breach is a 6  day suspension. We believe that 5 days is appropriate.
