Accordingly, FLOOZIE CAT is to be ridden by the declared rider, Mr R Elliot in Race 4.

Facts:

Prior to race 1, a request for a ruling was filed pursuant to rule 330 (2) for Race 4, The BDC Paints 210. The Informant requested a ruling that Mr D Mo should be engaged for her runner FLOOZIE CAT as he was originally engaged to ride that horse but was not down as the declared rider.

Rule 330 (2) reads: any dispute with reference to the engagement or engagements of a rider to ride at a particular race meeting or race meetings shall be determined by a judicial committee at the request of a stipendiary steward or any of the parties to a dispute.

Submissions for Decision:

Mrs Moseley explained to the Committee that on the 2nd of November they engaged Dylan MO to ride their horse FLOOZIE CAT for the Te Rapa meeting on the 7th November. This was because he had ridden her on numerous successful occasions. On the 4th November The Moseleys learnt that Mr Mo had been suspended and would be unable to ride their horse. For that reason they engaged Mr Ryan Elliot to ride FLOOZIE CAT. At the enquiry concerning Mr Mo's suspension the Committee was told by Mrs Zimmerman, who was representing Mr Mo, that Mr Mo did not have any confirmed rides over the next 7 days. The Committee on learning this suspended Mr Mo with effect from the conclusion of racing that day until after racing on the 18th November. Today's Committee was advised that Mr Neal had approached the JCA (as a result of talking to Mr Sharrock) and requested a change to the commencement date of Mr Mo's suspension. The starting date of the suspension was subsequently changed to the conclusion of racing on the 7th November. However this was not communicated to trainers in general and Mr and Mrs Moseley in particular. Once the Moseleys learnt that Mr Mo would be riding at Te Rapa they filed an information requesting Mr Mo be reinstated to ride FLOOZIE CAT.

Reasons for Decision:

The Committee has carefully considered the issues regarding this enquiry. While we have considerable sympathy with Mr and Mrs Moseley in this unfortunate situation we rule that FLOOZIE CAT is to be ridden by the declared rider, Mr R Elliot. The reasons for this are that Mr and Mrs Moseley had declared Ryan Elliot to ride their horse and had arrived at the races on that basis. The committee was also aware that two other horses would be affected if there was a change of rider in this case. Another reason in our decision was that betting had already opened for the race meeting before this application was filed.
