Following race 5 an Information was filed pursuant to Rule 530(2)(b) by the informant, Mr J Oatham.  He alleged that Mr Parish used the whip in an unnecessary manner on KOUSSO.

Following race 5 an Information was filed pursuant to Rule 530(2)(b) by the informant, Mr J Oatham.  He alleged that Mr Parish used the whip in an unnecessary manner on KOUSSO.

Mr Parish admitted the breach and was represented by trainer, Mr J Collett.

Mr Oatham demonstrated the video film and showed Mr Parish hitting his mount on several occasions in the neck area, between the 600 metre mark and 200 metres when a long last.  Mr Oatham said the horse was tailed off and the use of the whip at this stage was absolutely unnecessary.

Mr J Collett agreed that it was unnecessary and thought this would be a learning curve for Mr Parish.

Mr Parish had nothing to add.

Mr Oatham stated that Mr Parish had been charged with the same offence on 24.11.07 with unnecessary use and was fined $500.  For that reason he submitted a $750 fine would be appropriate.

PENALTY:

--

The Committee considered the submissions and were clearly of the opinion that Mr Parish’s use of the whip was unnecessary and an unprofessional look from a public’s viewpoint.  Obviously with Mr Parish having a previous breach of this Rule in the current season, this had to be reflected in this penalty.  Accordingly we impose a fine of $750.
