Following Race 4 an Information was filed pursuant to Rule 871(1) (D). The Informant Mr J Oatham alleged that Mr N Harris rider of Tonafun allowed his mount to shift outwards when not sufficiently clear causing Vantastic to check near the 600 metres.

Following Race 4 an Information was filed pursuant to Rule 871(1) (D). The Informant Mr J Oatham alleged that Mr N Harris rider of Tonafun allowed his mount to shift outwards when not sufficiently clear causing Vantastic to check near the 600 metres.
--Mr Harris admitted the breach.
--Mr M Davidson Stipendiary Steward demonstrated the video films which clearly showed Mr Harris, riding Tonafun, move out from Mr Lammas on Joey Rand and into the line of Vantastic (M. Sweeney) when approximately ¾ length clear of that runner.
--PENALTY SUBMISSIONS
--Mr Oatham said Mr Harris had a very good record and had pleaded guilty at the first opportunity. He said however that Mr Sweeney had lost some considerable ground as a result of the check. He submitted it was in the mid range of carelessness.
--Mr Harris told the Committee he had firm engagements for Ellerslie on 11th February & wished any suspension to begin after that.
--PENALTY
--The Committee considered all evidence and before imposing a penalty took into account the following.

- His excellent riding record --
- Level of carelessness and the effect on Mr Sweeney. The Committee noted that Vantastic finished on for 4th
Accordingly we impose a suspension to start after racing on February 11 and conclude after racing on February 18 (5 days).
