Decision:

Following Race 1 an Information was filed pursuant to Rule 866 (1) (C). The Informant Mr J Oatham alleged that Ms R Smythe rider of Colorado, failed to ride her mount out fully to the finish which may have cost her a reasonable chance of a better placing. Ms Smythe pleaded guilty and was represented by her employer Mr S McKee.



Following Race 1 an Information was filed pursuant to Rule 866 (1) (C). The Informant Mr J Oatham alleged that Ms R Smythe rider of Colorado, failed to ride her mount out fully to the finish which may have cost her a reasonable chance of a better placing. Ms Smythe pleaded guilty and was represented by her employer Mr S McKee.

Mr M Davidson, Stipendiary Steward, demonstrated the video films which showed Ms Smythe stop riding her mount out approximately 2 strides from the post. This enabled Shinko Bay to get up and beat her for 4th position. The margin between 4th & 5th was ½ a head.

PENALTY SUBMISSIONS

Mr Oatham said this was Ms Smythe’s first charge and the Committee should consider this and her inexperience, having had only 57 rides. However he said Ms Smythe’s actions cost the owner $875 in lost stakes being the difference between 4th and 5th. He submitted a fine of $400 - $600 would be appropriate.

Mr McKee said it was simply an error of judgement on Ms Smythe’s part.

The Committee considered all evidence and before imposing a penalty took into account the following.
