Following race 10 an information was filed pursuant to Rule 871(1)(d) when<BR>it was alleged by the informant, Stipendary Steward Mr C George, that Mr A Calder, rider of LORD LOWTHER, committed a breach of that rule<br><br>DECISION & REASON:<BR>Following race 10 an information was filed pursuant to Rule 871(1)(d) when<BR>it was alleged by the informant, Stipendary Steward Mr C George, that Mr A Calder, rider of LORD LOWTHER, committed a breach of that rule when he shifted inwards near the 1000 metres when not sufficiently clear of WINSOME KASH (C Ormsby) who had to be checked.<BR><BR>Mr Calder did not admit the charge.<BR><BR>Mr Oatham demonstrated the videos. He showed Mr Calder on his mount LORD LOWTHER racing on the outside of BAIANA ridden by Ms C Tremayne at the head of the field. As Ms Tremayne moved across to the rail Mr Calder, who was ? of a length behind her, followed. In doing so he took the line of WINSOME CASH when not sufficiently clear. Mr Oatham suggested the distance was a bare length. He also showed Mr Ormsby taking hold of his mount and the subsequent check that he received.<BR><BR>Mr Ormsby confirmed that Mr Calder was only 1 ? lengths clear when he took his line.<BR><BR>Mr Calder, in his defense, admitted that he was not the required distance<BR>clear but he claimed that his horse was racing greenly and he was attempting to keep him in a straight line.<BR><BR>After reviewing the relevant videos and other evidence and noting that Mr<BR>Calder accepted that he was not the required distance clear the committee<BR>preferred the evidence of Mr George. Consequently we find Mr Calder guilty<BR>as charged.<BR><BR>PENALTY:<BR>Mr George gave Mr Calder's record which included two warnings for careless riding in the last week. He asked that a suspension be imposed.<BR>Mr Calder asked for a suspension and a fine so that he could fulfill forward<BR>commitments.<BR>The committee accept Mr George's submissions and consequently suspend Mr Calder from riding from the conclusion of racing on 10 September until the conclusion of racing on 17 September 2006.<BR><BR><BR> D C Johnstone A Dooley<BR> CHAIRMAN<BR><BR><BR><BR>.<BR>.<BR>
