Accordingly after taking all the above into account we impose a suspension on Miss Spratt from riding in races which is to start after racing on 12 February and conclude after racing on 18 February 2011 (4 days).

Facts:
Mr J Oatham alleged that Miss Spratt permitted her mount TURPEN to shift outwards near the 200 metres when not sufficiently clear of SAVVY DANCER (C Grylls) which was checked.
Submissions for Decision:
Mr Coles demonstrated the video films and pointed out Miss Spratt moving out approximately 4 horse widths and into the line of SAVVY DANCER. He conceded that TURPEN had been hanging but Miss Spratt had continued to ride forward when she should have stopped to straighten her mount. He said she had ample warning that her mount was about to shift because of its hanging tendencies.
Miss Spratt admitted she should have stopped riding to straighten but said she had been having trouble throughout the race with the horse hanging.

Mr Oatham told the committee this was Miss Spratt's first charge for careless riding in 12 months which was an excellent record. He submitted her carelessness was at the low end although she did have prior warning her mount may shift out which she did not heed.
Miss Spratt said she had commitments until after racing on 12 February 2011.

The committee carefully considered all evidence and submissions as presented. Miss Spratt's admission of the breach and her excellent record were mitigating factors in her favour. The aggravating factor was that Miss Spratt continued to ride forward when moving out when she should have stopped riding to straighten her mount.
