In fixing penalty the Committee was mindful that equine welfare is paramount.
Facts:
Following the running of Race 8 (NZB Ready To Run Sale 1400) Information No. A12920 was filed with the Judicial Committee. It was alleged that Ms Schofer, the Rider of ARICINA used her whip excessively prior to the 100m.
Ms Schofer and Mr Harris said that they understood the Rule and the Charge and confirmed that the breach was admitted.
The films were shown to the Committee with Mr Williamson Stipendiary Steward identifying Ms Schofer and her mount. He then submitted that the films showed that Ms Schofer had struck her mount with the whip 9 times prior to the 100m. He said that she also struck her mount one more time but that it may have been on or inside the 100m. He concluded by saying that the whip use by Ms Schofer was clearly outside the established guidelines. (5 strikes only prior to 100m).
Ms Schofer for her part said that she agreed with the Stipendiary Steward’s interpretation of her whip use. She added that she had been out of riding for some time and that today was her first day back since the introduction of the new Whip Guidelines which came into effect on 7 October 2019.
Mr Harris reiterated that Ms Schofer had had time off from race riding and that she had got a bit excited. He added that although her whip use was excessive she did not ride with aggression.
Submissions for Penalty:
Mr Jones advised the Committee that the records showed that this was Ms Schofer’s first breach under the revised directive, and that her whip use was not near the high-end as there was not a lot of force used when Ms Schofer struck her mount.
Ms Schofer asked the Committee to take into account what had been submitted earlier, with Mr Harris stating that he would be assisting Ms Schofer in his advisory role with regards to acceptable whip use.
Reasons for Penalty:
The Committee was satisfied that Ms Schofer had struck her mount 9 times prior to the 100m. It also noted that the whip use was not continuous, and with only minor force being used. Also taken into account was that this was the Respondent’s first breach since returning to race riding.
Taking into consideration all matters relating to penalty, the Committee determined that there was not any reason why there should be a departure from the JCA Penalty Guideline for a first breach of the Rule.
