As the breach was admitted we find the charge proved.
Penalty:
After taking all the above into account and under the provisions of rule 1106 (2) we impose a suspension on Miss Spratt from riding in races which is to start after racing on 11 February and conclude after racing on 17 February 2012 (4 days).

Facts:
Following race 4 an information was filed pursuant to rule 638(1) (d). Mr Oatham alleged that Miss S Spratt permitted her mount (CATERINO) to shift in when not clear dictating CRUSH TORQUE ( Miss M Wenn) into the line of KATE (Miss S Collett) which was checked causing it to lose ground. This occurred passing the 1100 metres.
Submissions for Decision:
Mr Coles demonstrated the video films which showed CATERINO, ridden by Miss Spratt, racing 3 wide 100 metres after the start. Mr Coles pointed out to the committee Miss Spratt angling her mount in towards the rail and said she was only 1/2 length clear of CRUSH TORQUE when doing so. This resulted in KATE having its line dictated by CRUSH TORQUE and receiving a sharp check as a result.
Miss Spratt in admitting the breach said she jumped so well she did not realise she had 2 runners so close to her on her inside.
Submissions for Penalty:
Mr Oatham told the committee that Miss Spratt had incurred 3 careless riding charges in the last 12 months. He believed this charge was mid range as Miss Collett had lost considerable ground as a result of the check she received. He submitted a suspension of 4 - 6 days would be appropriate.
Miss Spratt said she had commitments up to and including 11 February 2012.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In Miss Spratt's favour are her admission of the breach and her good record for the number of rides she has. However on this occasion she was only 1/2 length clear when moving in which resulted in a sharp check to KATE. Normally we consider this breach would deserve a 5 day suspension but because of the mitigating factors outlined and because only 1 horse was affected we find this breach to be in the low to mid range.
