Following Race 7 an Information was filed pursuant to Rule 520 (4) (c). The Informant, Stipendiary Steward JP Oatham, alleged that Defendant Troy Harris had "failed to make the contracted weight for HEZA KARMA KARZI, in race seven, the HS Dyke Waikato Guineas".

Following Race 7 an Information was filed pursuant to Rule 520 (4) (c). The Informant, Stipendiary Steward JP Oatham, alleged that Defendant Troy Harris had "failed to make the contracted weight for HEZA KARMA KARZI, in race seven, the HS Dyke Waikato Guineas".

The Defendant confirmed his admission of the breach.

Addressing the charge Stipendiary Steward Oatham stated that when weighing out for the Group Three Waikato Guineas the Defendant was found to be one kilo over his carded weight, 56 kilograms. The Defendant was allowed to change riding gear in an attempt to make the correct weight but this proved futile, and the connections were forced to seek a replacement rider when the Defendant was ruled out of contention.

Mr Oatham described the Defendant’s failure to meet his contracted weight obligations as unacceptable to the connections and the betting public, particularly as the race was of Group status.

When given the opportunity to respond to the Stipendiary Stewards presentation to the Committee, Defendant Harris advised that in an earlier race that day, race four, he had weighed out and ridden at 56 kilograms, the same weight he had later failed to make. The Defendant stated that following race four he had felt dehydrated, and had taken a drink of water to compensate for that condition.

Taking issue with the Defendant’s claim that remedying dehydration had led to his failure, the Informant contended that the Defendant should have been aware that under the circumstances he faced he should not have had a drink.

Penalty:

--

The Informant detailed a significant history of weight related charges which the Defendant had faced, with a recent instance - only days previously - incurring a fine of $400.00. He reiterated that the Group status of race seven and problems the connections faced when forced to find a replacement rider at a late stage, were factors for the Committee to consider when addressing penalty. The Informant submitted that the breach warranted a fine of "not less that $1,000.00".

The Defendant had no comment to make as to penalty.

Decision:

Deliberating, the Committee noted that notwithstanding his recent breach, there had been some improvement since 2007, when weight had been a real issue for the Defendant.

--

The Committee agreed with the recommendation of the Stipendiary Steward that a fine was appropriate, and in determining penalty factored in the Group status of race seven, the connections being forced to find a late replacement, and the overall interests of the industry and the betting public.

--

The Committee, delivering penalty, reminded the Defendant that he was an accomplished rider with his own following, and that his actions in not making the contracted weight were irresponsible.

--

The Defendant was fined $1,000.00 for the breach.
