Charge:
Following the running of Race 7, an information was filed pursuant to Rule 638 (2). The informant, Mr Oatham, alleged that Ms Houston made a celebratory gesture on THE FOX, prior to the winning post.
Facts:
Mr Oatham demonstrated on the video films that Ms Houston raised her whip in the air 3 strides before the finish line.
Ms Houston told the committtee that it was a personal hurdle she had achieved by winning the race and thought she was passed the line when making the gesture.
Submissions for Penalty:
Mr Oatham submitted the celebratory gesture was at the low end of the scale and Ms Houston had a clear record under this rule. However, he said the rule was in place for good reasons. He referred to a recent similiar breach when a jumps rider received a $150 fine and believed this incident warranted the same penalty.
Ms Houston had no comment to make on penalty.

The committee carefully considered the submissions presented. The mitigating factors are Ms Houston's admission of the breach and her clear record under this rule. We assess the gesture to be at the low end of the scale and took into account this was the last jumps day of the season. After taking into account all these factors we believe an appropriate penalty is a fine of $150.
