As Mr Coleman admitted the breach the Committee find the charge proved.

Penalty:

Accordingly the Committee imposes a suspension on Mr Coleman which will commence after racing on 8 October and conclude after racing on 16 October 2014 (4 North Island days).

This period includes a deferment pursuant to Rule 1106(2).

Facts:

Following the running of race 2, the Topsoil & Sand Supplies (2011) Ltd 1200, an Information was lodged pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that near the 300 metres Mr Coleman angled his mount PERSUASIVE to obtain clear running, thereby causing a check to LOOKATMEPINS which lost ground. 

Mr Coleman acknowledged that he understood the nature of the charge and the Rule, and confirmed that he admitted the breach.

Rule 638(1)(d) states : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified the horses PERSUASIVE and LOOKATMEPINS on the head-on film. He pointed out that PERSUASIVE was being held up when looking for a run at about the 300 metres mark. Mr Coleman had angled the horse inwards inside CHARLEY FARLEY and in doing so had caused a sharp check to LOOKATMEPINS ridden by Mr C Grylls. At that time PERSUASIVE had only been between 3/4 to 1 length clear of LOOKATMEPINS. Mr Coles added that it had been an error of judgment on Mr Coleman's part, and while it appeared that LOOKATMEPINS had not been running on it was clear from the films that the Rule had been breached.

Mr Coleman agreed that he had made an error of judgement, and added that he had been unaware that LOOKATMEPINS was inside him when he attempted to find a run for his horse. He said that the interference had been unintentional.

Submissions for Penalty:

Mr Willamson produced Mr Coleman's record which showed one previous breach of this Rule in the past 12 months, which was at Matamata on 27 August 2014 when he was suspended for a period of 3 riding days. He added that Mr Coleman had an outstanding record, and had been frank in his admission of the breach. He added that the horses had been racing in tight quarters on this occasion and that had aggravated the situation.

Mr Williamson submitted that his assessment of this breach was that it was at the mid-low level on the scale of seriousness and that in his opinion called for a suspension at the lower level.

Mr Coleman submitted that he also felt the breach was at the lower end of the scale. He confirmed that he had engagements at Taupo on 8 October and any period of suspension could commence after that. He confirmed that he only rode in the North Island.

Reasons for Penalty:

The Committee carefully considered all of the evidence and the submissions presented. We adopted 5 riding days as the starting point in considering the term of suspension to be imposed on Mr Coleman. The mitigating factors are Mr Coleman's early admission of the breach, and his good record in relation to breaches of this Rule considering his extensive riding history. While this breach fell into the lower end of the scale, and the effects of it were minimal, the Committee was still required to impose an appropriate penalty.

After taking into account all of the above factors the Committee considers a 4 day suspension to be fitting on this occasion.
