Decision: Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that Mr Jason Collett, rider of COLORADO, committed a breach of that Rule when he permitted his mount to shift inwards after the start when not sufficiently clear
DECISION & REASON:
--Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham, that Mr Jason Collett, rider of COLORADO, committed a breach of that Rule when he permitted his mount to shift inwards after the start when not sufficiently clear of CAPE FEAR (L Cropp) who was dictated inwards causing a check to STRIKER (T McMullen) and tightening LACYLINI (T Harris).

Mr J R Collett admitted the breach and was represented by Mr L V Goord (owner).

Stipendiary Steward Mr M Williamson demonstrated the video films and showed where shortly after the start Mr Collett came across on his mount when not the required distance clear tightening CAPE FEAR and L Cropp had to take a hold of her mount causing subsequent checks to STRIKER and LACYLINI.

Mr Collett had nothing further to add.

Mr Goord stated that Mr Collett was marginally clear and Miss Cropp had over-reacted from the movement from her outside.

Mr Oatham produced Mr Collett’s record which was excellent – he has had approximately 100 mounts in his 4 month career and this was his first charge. He pointed out that Mr Collett was never clear and dictated Miss Cropp’s line. He submitted a 4 day suspension. Mr Collett stated he had confirmed riding engagements for Taupo on 8 October.

The Committee carefully considered all submissions and before imposing a penalty took into account the following:
----
1. Guilty plea.
--2. Mr Collett’s excellent record.
--3. Degree of carelessness.
--4. The interference suffered by Miss Cropp, Miss McMullen and Mr T Harris.

Accordingly the Committee imposed a suspension to be served by J R Collett starting after racing on 8 October and to conclude after racing on 15 October, 4 days.
