Decision:

The information alleges that L. Innes made a celebratory gesture prior to his mount ?Crossyourheart? passing the ?Winning post?

The information alleges that L. Innes made a celebratory gesture prior to his mount ?Crossyourheart? passing the ?Winning post?

--

 Mr Innes was present at the hearing and admitted the breach.

--

 The rule was read and Mr Innes acknowledged he understood same.

--

 A film of the alleged incident was shown to the Committee this clearly showed Mr Innes stand up in the irons and begin waving his whip in the air from approximately 50 metres from the ?Winning Post? and continued to do so until past the post.

 Whilst he was making the celebratory gestures he only had one hand on the reins and any sudden movement from his mount could have easily dislodged him.

--

 Mr George described Mr Innes's actions as potentially dangerous and a very serious breach as it started so far from the ?Winning Post?.

 Mr Innes acknowledged his actions were somewhat foolish but said he got carried away.

--

 Mr George in his submission as to penalty said he viewed the breach very seriously and it warranted a substantial penalty.

 Mr Innes in his submissions as to penalty referred the committee to other breaches of what he though were of a similar nature.

--

 The committee then asked for Mr Innes's record re this offence and were told he had never been charged with this particular action.

 Both parties acknowledged that they had nothing further to add and left the committee to set a penalty.

 When arriving at a penalty the Committee took into account Mr Innes's frankness with them and his regret for his actions, they also took into account that it was his first breach of this kind.

--

 These factors however were heavily outweighed by the fact that he is a senior rider and put his mount at risk in a $500,000-00 race and his celebratory gesture started some 50 metres prior to the winning post. They felt the penalty must reflect the seriousness of his actions and be of a substantial nature and act as a deterrent to himself and others. They therefore imposed a fine of $1500-00.
