Decision:

Following Race 7 an Information was filed pursuant to Rule 871(1) (d).The Informant, Stipendiary Steward Mr J Oatham alleged, that Mr E Dalley permitted his mount LADY LUCILLE to shift outwards near the 200 metres when not sufficiently clear of THE STRUTTER ( J Collett) who was checked.

Following Race 7 an Information was filed pursuant to Rule 871(1) (d).The Informant, Stipendiary Steward Mr J Oatham alleged, that Mr E Dalley permitted his mount LADY LUCILLE to shift outwards near the 200 metres when not sufficiently clear of THE STRUTTER ( J Collett) who was checked.

Mr Dalley admitted the breach and was represented by his employer Mr R Priscott.

Mr Williamson demonstrated the side on film which clearly showed Mr Dalley riding Lady Lucille which was racing on the fence near the 200 metres, when he angled his mount out, but in doing so took the line of The Strutter, ridden by J Collett, who had to check his mount. Mr Williamson said Mr Dalley had moved out 3 horse widths and continued to ride forward when not the required distance clear.

Mr Dalley and Mr Priscott had nothing to offer.

PENALTY SUBMISSIONS

--

Mr J Oatham said Mr Dalley had not previously been charged in his 147 rides to date. He considered the interference was low to mid range, but believed a suspension was warranted at the lower end.

Mr Priscott confirmed it was Mr Dalley’s first breach of this rule and asked the Committee to take this into account.

--

Mr Dalley informed the Committee he had firm commitments on May 2. He stated that he rides only in the North Island.

PENALTY

--

The Committee considered all submissions and before imposing a penalty took into account:

--

1: Mr Dalley’s excellent record.
2: His guilty plea.
3: His level of carelessness which we believe was at the lower end.

--


Accordingly we impose a suspension to start after racing on May 2 and to conclude after racing on May 9 2009 (4 Days)
