Following Race 1 an Information was filed pursuant to Rule 866(1) (b). The Informant, Stipendiary Steward Mr J Oatham alleged, that Mr T Hazlett the rider of OPPORTUNITY KNOCKS failed to take all permissible measures over the final 800 metres to ensure that his mount was given full opportunity to win the race or obtain the best possible finishing place.

Following Race 1 an Information was filed pursuant to Rule 866(1) (b). The Informant, Stipendiary Steward Mr J Oatham alleged, that Mr T Hazlett the rider of OPPORTUNITY KNOCKS failed to take all permissible measures over the final 800 metres to ensure that his mount was given full opportunity to win the race or obtain the best possible finishing place.
--Mr T Hazlett admitted the breach.
--Prior to the commencement of this information the Chairman asked Mr Hazlett if he accepted this charge to be heard on raceday. He confirmed he was happy to proceed with the case, which took place at the completion of Mr Hazlett’s riding engagements.
--Mr Williamson demonstrated the video films which showed Mr Hazlett at the 800 metre mark racing in 9th position, one off the rail. He said Mr Hazlett made no effort to improve his position at the 800 metres, when other riders around him were pushing their mounts forward to improve their position. He said it was clear on the video that Mr Hazlett showed no urgency and lacked any vigor. He informed the Committee that Opportunity Knocks was having its first start over hurdles. The horse finished officially in 6th place, 3.1 lengths from the winner.
--Mr Oatham said it was quite clear Mr Hazlett had shown little vigor. He said that it was from the 700 metres to the 400 metres which Mr Hazlett let the race get away from him. He also confirmed the horse was having its hurdle debut.
--Mr Hazlett said he basically went to sleep. He admitted that he is normally an aggressive rider and the ride on this occasion did look very ordinary on the video.

PENALTY SUBMISSIONS.
Mr Oatham said Mr Hazlett had an excellent record spanning over 22 years. He said Mr Hazlett should be commended for his full admission of the breach, he believed there was nothing sinister with his ride and agreed with Mr Hazlett’s admission of “going to sleep”. He said the breach was at the lower end of the scale for a breach of this rule, and submitted a 3 week suspension was appropriate.
--Mr Hazlett said he had firm commitments on May 1 at Riverton. He also had opportunities at the Warrnambool Carnival in Australia next week. He highlighted to the committee that he had opportunities to ride Mr Oulaghan horses at the upcoming premier jumps day at Te Rapa. He believed the fact that Opportunity Knocks was having its first start over hurdles had a bearing on his attitude towards the horse’s chances. To his knowledge the horse had limited jumping experience. He said that this was an embarrassing situation to be in.
PENALTY
The Committee pointed out to Mr Hazlett this is a rule that is rarely used .It is very mindful that every breach of this rule creates a different situation and there are very little previous charges recorded for jumps riders.
--The Committee carefully considered all submissions and before imposing an appropriate penalty took into account:
--1: Mr Hazlett’s guilty plea.
2: His excellent riding record spanning over 22 years.
3: The limited opportunities for jump jockeys.
After taking all factors into account we impose a suspension on Mr Hazlett from riding in races starting after racing on May 1 and to conclude after racing on May 15 2009 (2 weeks) and in addition imposed a fine of $1,000.
