As Mr Hills admitted the breach we find the charge proved.
Penalty:
Accordingly, we impose a suspension on Mr Hills which will commence after racing on October 30 and conclude after racing on November 8 (5 North Island days).
Charge:
Following race 8, Cambridge Training Complex 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Hills angled his mount LADY CHAPEL outwards near the 250 metres causing interference to STITCHENTYNE.
Mr Hills acknowledged that he understood the nature of the charge and the Rule.
Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Mr Williamson identified that near the 250 metres Mr Hills angled his mount LADY CHAPEL outwards causing interference to STITCHENTYNE. He said this resulted in STITCHENTYNE receiving heavy contact which caused her to lose momentum when they were racing on level terms.
Mr Hills admitted that he angled out when not the required distance clear of STITCHENTYNE.
Submissions for Penalty:
Mr Oatham produced Mr Hills’ record which showed 1 previous breach under this Rule in the last 12 months. This occurred in January 2013. He said Mr Hills rides extensively over the North Island and described his record as very good. He assessed the interference as mid range noting that Mr Hills shifted out abruptly which resulted in his mount being relegated from 2nd to 4th place. He submitted a penalty in line with the breach would be appropriate.
Mr Hills asked the Committee to take into account his very good record.
Mr Hills advised that he had upcoming commitments at Counties on October 30, and that any period of suspension could commence after that.
In response to a question from the Committee, Mr Hills advised that he had no intention of riding at Invercargill or Banks Peninsula in November.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Hills' admission of the breach and his very good record in relation to this Rule. However, this has to be balanced against the significant aggravating factors. These being Mr Hills' actions resulted in a relegation which impacted on LADY CHAPEL’S connections and the betting public who had invested on her. We assess the level of carelessness as clearly mid range, Mr Hills was racing on level terms with STITCHENTYNE and he literally forced his way out.
After taking into account all the above factors we consider an appropriate penalty is a 5 day suspension.
