Following race 2 Stipendiary Steward J Oatham filed an information pursuant to Rule 871 (3) alleging that Apprentice Jockey Mr Darryl Horner had made a celebratory gesture prior to the winning post.



Following race 2 Stipendiary Steward J Oatham filed an information pursuant to Rule 871 (3) alleging that Apprentice Jockey Mr Darryl Horner had made a celebratory gesture prior to the winning post.

Mr Horner, represented by Mr L A O’Sullivan to whom he is apprenticed, admitted the charge.

--

At the request of the Informant the video of Race 2 was shown demonstrating the actions of the Defendant, and the clear breach of the Rule.  Mr Oatham opined that the Defendant, when recording his first win in twelve raceday rides had ‘got carried away”.

Mr O’Sullivan explained that the Defendant had been very excited at his first win.

--

In his comments as to penalty the Informant recommended that a fine in the order of  $300.00 would be an appropriate sanction.

Mr O’Sullivan drew the Committee’s attention to the fact that the Defendant was “not paid very much” and that a large fine would impact on his financial status.

The Committee considered the nature of the breach and submissions as to penalty from both parties. 

--

 

--

Taking heed of the Defendants admission, his low income level and the circumstances of the breach, the Committee imposed a fine of $275.00.

--

The Defendant was reminded of the perils of his actions in breaching the Rule.
