Following Race 7 an Information was filed pursuant to rule 330 (3) (c). The Informant, Mr Oatham, told the Committee that Mr T Harris was unable to make the handicapped weight for the horses GAROZZO, THE HECKLER and INQUISITION. These horses were starters in Race 1, 5 & 10.

Following Race 7 an Information was filed pursuant to rule 330 (3) (c). The Informant, Mr Oatham, told the Committee that Mr T Harris was unable to make the handicapped weight for the horses GAROZZO, THE HECKLER and INQUISITION. These horses were starters in Race 1, 5 & 10.
--Mr Harris pleaded guilty to the charge.
--Mr Oatham explained to the Committee that Mr Harris was a kilo over for his first mount at 55 ½ kgs and ½ kg over for the 2 at 56kgs. Connections of those 3 horses requested that Mr Harris be replaced. Mr Harris said he had been trying hard with his weight and thought he would make his carded weight today without too much trouble.
--PENALTY SUBMISSIONS
--Mr Oatham produced Mr Harris’ record which showed 5 previous charges in the last 12 months. He said that Mr Harris has to sort out the problem as it was unfair to connections to assume he can make the weight and then arrive at the races to find he can’t. He submitted a suspension was now necessary but should be at the lower end.
--Mr Harris confirmed he had no further commitments after today’s racing.
--PENALTY
--The Committee carefully considered all the evidence and submissions before imposing an appropriate penalty. In mitigation we take Mr Harris’ guilty plea into account but this has to be weighed against the main aggravating factor of the inconvenience to connections of Mr Harris’ mounts.
--The Committee explained to Mr Harris their concern at this ongoing problem which Mr Harris obviously has. Because of his record and taking all the above factors into account we agree a suspension is necessary. Accordingly we impose a suspension on Mr Harris from riding in races to start after today, 26 October 09, and conclude after racing on 31 October 2009 (4 days)
