CHARGES:
--Following race 2 an information was filed pursuant to rule 638 (1) (d). The informant Mr George alleged that Mr A Calder (VERONICA FRANCO) shifted in near the 900 metres hampering TINSELTOWN (C Grylls) taking that runner from his rightful line of running.

FACTS:
--Mr Williamson demonstrated the video films which showed Mr Calder riding VERONICA FRANCO racing in a 3 wide position nearing the 900 metres. It was evident on the films that Mr Calder allowed his mount to move in approximately one horse width and in doing so take the rightful line of TINSELTOWN. Mr Williamson said Mr Calder moved in deliberately to reach a two off position and was not the required distance clear of TINSELTOWN.

Mr Calder had no questions on the interpretation of the films.

Mr Grylls called as a witness by Mr George said he was racing in a one off position behind CHETTAK at the 900 metres. He said he was slightly dictated in to a position on the fence.

SUBMISSION(s):
--Mr Calder said he was travelling well at the 900 metres and admitted he put slight pressure on Mr Grylls. He told the committee he believed there should be a margin of error allowed in races as he considered on this occasion his carelessness was minor. He conceded that contact did occur but when it did he released the pressure immediately.

Mr George conceded to the hearing that TINSELTOWN had not been severely checked. However it did have its rightful line of running taken away by the inward movement of VERONICA FRANCO. He said it was a deliberate movement on Mr Calder’s part and even though this was a marginal error falls can still result.
----
DECISION:
--The committee considered all evidence and submissions. While we concede that Mr Calder did not move in to any great extent we are satisfied that this movement did take the line of TINSELTOWN. By his own admission Mr Calder admitted he was only half a length clear and Mr Grylls upon questioning confirmed he had been pushed in from a two off position to one on the rails. As Mr George pointed out to the hearing there is a fine line between carelessness and competiveness and we believe on this occasion Mr Calder compromised the competitive element. It was clearly evident that Mr Grylls had to check his mount as a result of Mr Calder’s inward movement. Mr Calder went from a three wide position to a two wide position when not the required distance clear.

Accordingly we find the charge proven.

SUBMISSION(s) ON PENALTY:
--Mr George said this was Mr Calder’s third charge in the last twelve months which was a good record. He said Mr Calder was a national rider and submitted a 3 – 4 day suspension appropriate.

Mr Calder stated his carelessness only deserved a fine as it was at the lowest end of carelessness. He said he had commitments up to and including 30 October.

REASON(s):
--The committee carefully considered all submissions and evidence. In Mr Calder’s favour are his good record and that he did not move in a significant amount. However as stated earlier he was not the required distance clear of TINSELTOWN when doing so.
----
PENALTY:
--Accordingly the committee imposes a suspension on Mr Calder form riding in races which is to start after racing on 30 October and concluding after racing on 5 November (4 riding days).
