Following race 8 an information was lodged by J Oatham, Stipendiary Steward, alleging a breach of Rule 871(1)(d): namely carelessly riding.

DECISION & REASON:
--Following race 8 an information was lodged by J Oatham, Stipendiary Steward, alleging a breach of Rule 871(1)(d): namely carelessly riding. The information alleges that C Anderson (apprentice) rider of TUI SONG (number 13) angled out for a run in the final straight, firstly making firm contact with ALBERTON ROSE (L Cropp) and then CHATTING (number 17) ridden by jockey T K Allan, when not the required distance clear.
----Ms C Anderson, assisted by her employer/trainer S Autridge, denied the charge.
----Mr Oatham called evidence from Mr A Coles, Stipendiary Steward, and jockey T K Allan. Mr Coles demonstrated on both head on and side on race videos the incident. He said that C Anderson angled out when not sufficiently clear and made contact with CHATTING (T K Allan).
--Mr S Autridge did not challenge Mr A Coles' evidence.
----Mr T K Allan gave evidence. He said that his mount CHATTING received interference from the inside. He said he received buffeting and that he was entitled to his line of running.
----Mr S Autridge made a statement on behalf of C Anderson. He conceded interference had occurred and that it did not affect CHATTING?S chances. He further said that she was riding the favourite and was attempting to get a run.
----We are satisfied that C Anderson angled out when not sufficiently clear of T K Allan's mount CHATTING. We prefer the evidence of Mr A Coles and T K Allan.
--We find the charge of careless riding proved to the required standard.
----PENALTY:
--After hearing submissions on penalty from Mr Oatham and Mr Autridge we determine that a suspension must be imposed. The sole issue is how long.
----Mr Oatham submitted that this is careless riding at the higher end of the scale and seeks a suspension between 4 to 6 days. Mr Oatham correctly points out that this interference could have had serious consequences.
----Mr Autridge said everything he could for her in mitigation.
----In this case there can be no credit for a plea of guilty.
----Taking into account all matters we consider a suspension of 4 days is appropriate. This is to commence from the conclusion of racing on 27 October up to and including 3 November 2004.
