Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr Oatham, that Mr D Walsh, the rider of RED BUNTING, angled out when not clear of DOUCE (N Harris) on his outside.

DECISION & REASON:
--Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr Oatham, that Mr D Walsh, the rider of RED BUNTING, angled out when not clear of DOUCE (N Harris) on his outside. DOUCE had to be checked and lost ground. Mr Walsh admitted the charge which means this Committee only has to adjudicate on penalty.
----Mr Coles, Stipendiary Steward, demonstrated the video films and showed where soon after turning for home Mr Walsh angled his mount out for a run and in doing so took the line of DOUCE on his outside. Mr Coles said Mr Walsh was only half a length ahead of DOUCE, but Mr Walsh only moved out approximately 1? horse widths.
----Mr Walsh admitted moving out when he was poking up for a better run, but in his opinion his carelessness was at the lower end of the scale. He said the movement was accidental as he didn?t realize the 2 horses on his outside were so close.
----Mr Oaltham said in his submissions that Mr Walsh's record was an excellent one with Mr Walsh having only one suspension in approximately 450 rides. He said the Committee should take into account Mr Walsh's guilty plea and his frankness in the matter.
----Mr Walsh told the Committee of his excellent record and he believed a fine to be appropriate.
----The Committee considered these submissions and taken into account Mr Walsh's excellent record, his guilty plea and his honesty throughout the inquiry. However, we are mindful that Mr Harris did receive a check at a vital stage of the race and believe a suspension is warranted. Accordingly we impose a suspension to start after the conclusion of racing on 25.10.06 and finish after the conclusion of racing on 1 November 2006 (3 riding days).
