Following race 4 an information was filed pursuant to Rule 520(4)(a) when it was alleged by Mr Oatham that Ms Cropp failed to fulfil an engagement made by her riders agent to ride the horse O?NOYOUDONT.

DECISION & REASON:
--Following race 4 an information was filed pursuant to Rule 520(4)(a) when it was alleged by Mr Oatham that Ms Cropp failed to fulfil an engagement made by her riders agent to ride the horse O?NOYOUDONT. Ms Cropp did not admit the breach.
----Mr Oatham said in his evidence that the horse was originally due to be ridden by Ms Treymane. However, as she was unwell and unable to ride Mr Goord accepted the engagement on Ms Cropp's behalf. This engagement took place on Sunday morning after trainer Mr M Todd phoned Mr Goord. Mr Goord confirmed this engagement with Mr Oatham on the morning of the races.
----Mr Oatham said it was only after race 3 that Ms Cropp finally said she would not ride the horse. He believed it was not good enough after an engagement had been accepted by her agent the day before and then saying she wouldn?t ride the horse within half an hour of the race.
----Ms Cropp said she did not know of the engagement until arriving at the races. She declined the ride because of the horse's racing manners.
----The Committee considered all the evidence and have taken all circumstances into account. We consider that when an engagement is accepted by an agent and subsequently confirmed by that agent to the Stipendiary Stewards on race day it is deemed to be a binding engagement, accordingly we find the charge proven.
----Ms Cropp in her submissions confirmed that the horse in question, O?NOYOUDONT had raced erratically in its last start.
----Mr Oatham said the penalty could be resolved by way of a fine and believed a sum of $150 to $250 was appropriate.
----PENALTY:
--The Committee considered all submissions and before imposing a penalty told Ms Cropp she must have better communication with her agent. Accordingly we impose a fine of $250.
