DECISION & REASON:
--This is an adjourned inquiry arising from the Waikato Racing Club’s meeting on 23 January 2008. An Information was filed pursuant to Rule 871(1)(d) by Stipendiary Steward Mr J Oatham when he alleged that Ms S Spratt, rider of REVERE in race 9, allowed her mount to shift inwards when not sufficiently clear of DEFOX (K Hercock) who clipped heels near the 800 metres.

Ms Spratt denied the charge and was represented by her employer, Mr R Yuill.

Mr W Robinson demonstrated the video films and showed that at approximately the 800 metre mark Ms Spratt moved inwards into the line of DEFOX ridden by K Hercock. He said Ms Spratt was racing 4 wide and moved in approximately one horse width. He said he heard K Hercock call out on more than one occasion. He said Ms Spratt made an error of judgement, and while conceding Ms Spratt did pull off it was after the check suffered by Ms Hercock.

Ms Hercock was called to give evidence and said that initially S Spratt was half to three-quarters of a length clear of her on her outside. She said Ms Spratt came from 4 wide to 3 wide and in doing so rolled under her neck causing her mount to clip heels. She also said she called to Ms Spratt on 3 occasions.

Ms Spratt said in her statement her horse tended to lean in and 2 strides before the incident she said she pulled out and also that the inside horse had rolled out and contributed to the interference.

Mr R Yuill said that while Ms Spratt did roll in she had done all she could to correct her mount. He believed there were a few issues in her favour which the Committee should consider.

Mr J Oatham said the evidence was clear that Ms Spratt had moved in one horse width when insufficiently clear and the charge should be upheld.

The Committee carefully considered all evidence and reviewed the video films. We are satisfied that Ms Spratt did allow her mount to move in and take the line of DEFOX when not the required distance clear of that runner. It is significant that Mr Robinson confirmed K Hercock’s statement that she called to Ms Spratt on 3 occasions. The video clearly showed that Ms Hercock’s mount clipped heels and nearly fell. Accordingly we find the charge proven.

Mr Oatham produced Ms Spratt’s record which showed 5 charges in the last 12 months. He believed this charge necessitated a suspension of 4 – 6 days.

Ms Spratt said she had commitments on 6 February and nothing after that.

The Committee carefully considered all submissions and believe a suspension is appropriate. We took into account Ms Spratt’s record, the degree of interference suffered by Ms Hercock’s mount and that it occurred on the point of the turn. Accordingly we suspend Ms Spratt from after the conclusion of racing on 6 February until after the conclusion of racing on 13 February 2008.
