Facts:
Following the running of race 1, Total Mortgages 1600, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr C Lammas, alleged that FANCY MORE or its rider placed 3rd by the Judge interfered with the chances of EASY M’LADY placed 4th by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st - No. 7 TATTYBOGLER
2nd - No. 5 O’HARA
3rd - No. 1 FANCY MORE
4th - No. 8 EASY M’LADY
The official margin between 3rd and 4th was a nose.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
All connections present acknowledged they understood the Rule.

Mr Lammas said that entering the final straight he was racing in a 3 wide position. He stated that Mr Waddell, the rider of FANCY MORE, improved on his inside and then moved out to make a gap for himself which pushed EASY M’LADY out 2 to 3 horse widths. As a result his mount was unbalanced which he believed cost him ½ a length and given the nose margin between the 2 horses at the finish he believed EASY M’LADY would have beaten FANCY MORE.
Mr Prendergast said he agreed with Mr Lammas assessment of the alleged incident. He said that Mr Waddell turned his horse’s head out passing the 300 metres and as a result EASY M’LADY was pushed out and lost at least 1 length.
Mr Waddell said that FANCY MORE came from behind EASY M’LADY and he did not deny that runner a run at any stage. He said that EASY M’LADY rolled out a bit then came in. He stated that he forced a run passing the 300 metres and as a result FANCY MORE touched EASY M’LADY which as a consequence “bounced off me”. He said Mr Lammas rode his mount with vigour after the incident and he did not touch his mount. He said that he caused “a little bit of interference” to EASY M’LADY but believed the best horse finished in 3rd place.
Mr Crawford said that Mr Lammas only stopped riding EASY M’LADY momentarily and stated that there was a “slight bump” between the 2 horses.
Mr Oatham on behalf of the Stewards said at the 350 metres FANCY MORE was racing ½ to ¾ of a length behind EASY M’LADY. He said that there appeared to be a “tight run” available for FANCY MORE to the inside of EASY M’LADY passing the 300 metres. He said there was contact between the 2 horses and both runners were unbalanced. He said the Committee had to consider whether Mr Waddell was entitled to pursue the “tight run” near the 250 metres.
Reasons for Decision:
The Committee carefully considered all of the submissions and reviewed the video films.
The Committee found that near the 300 metres FANCY MORE was held up for a run to the inside of EASY M’LADY. Mr Waddell continued to pursue a marginal run to the inside of EASY M’LADY. The back on film was compelling and it showed that once Mr Waddell had established a narrow run near the 250 metres he turned his horses head out and rode FANCY MORE out onto EASY M’LADY for a few strides. As a consequence EASY M’LADY was forced off its rightful running line and unbalanced which impacted on its momentum.
Having considered the degree of interference, the manner in which both horses finished the race off and significantly the nose margin at the finish the Committee is of the opinion that EASY M’ LADY would have finished in advance of FANCY MORE had such interference not occurred.
