Decision:

Following Race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant that near the 150 meter MULYITASKER ridden by Mr C Lammas shifted outwards causing a check to KEEPAFLYIN (A Peard) who was forced out onto YOUG ZEUS (B Jones)



Following Race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant that near the 150 meter MULYITASKER ridden by Mr C Lammas shifted outwards causing a check to KEEPAFLYIN (A Peard) who was forced out onto YOUG ZEUS (B Jones)

Mr Lammas pleaded guilty.

Mr Coles demonstrated the video films and showed where MULTI TASKER moved out approximately 2 horse widths, taking the line Mr Peard without being the required distance clear. This caused Mr Peard to initially move out onto YOUNG US before he had to switch to the inside of Mr Lammas to gain a clear run.

Mr Lammas said while admitting, he rolled out, he thought he was clear of Mr Peard.

Mr Lammas said he had confirmed rides for Rotorua on 27 December.

Mr Oatham produced Mr Lammas’s record which showed only one charge in the last 12 months.

He said Mr Lammas did, however, move out two horse widths causing the resultant crowding. He believed a suspension was necessary but the carelessness was at the lower end of the scale.

The committee considered all submissions and before imposing a penalty considered the following:

--

1/ Mr Lammas’s riding record

--

2/ His guilty plea

--

3/The degree of carelessness which we believe was not major

--

4/ His confirmed rides at Rotorua

--

Accordingly we impose a term of suspension to start after racing on 27 December2007 and conclude after racing on 31 December2007. (4 days)
