The breach is admitted and therefore the charge is proved.

Penalty:

The Committee orders that Miss Collett's License to ride is suspended for a period to commence after racing on the 24th of September 2017 and conclude after racing on the 30th of September 2017 (4 days)

The meetings during that period are :

Avondale JC on 27 September

Waipukerau RC on 28 September

Gore RC on 29 of September

Auckland RC on 30 September.

Facts:

Following the running of the CROSSROADS WAIKATO'S No 1 PUB TAB 1600, an Information was lodged by Stipendiary Steward, Mr B Jones against Class A Jockey, Miss A Collett alleging that Miss Collett when racing near the 250 metres mark from the finish angled her horse TRAILBLAZER out when not sufficiently clear of ARTIC MISS which was hampered and checked.

Rule 638(1)(d) provides:A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Miss Collett was present at the hearing and acknowledged that she understood the Rule and admitted the breach.

Senior Stipendiary Steward, Mr M Williamson demonstrated the incident by use of the race films. He showed where passing the 250 metres mark TRAILBLAZER was racing on the inside and just ahead of ARTIC MISS. He said that Miss Collett's horse was not sufficiently clear of ARTIC MISS when she moved out and caused the rider of that horse to take hold and steady his mount. He said that Miss Collett was under a length clear and that she had obviously misjudged the distance.

Miss Collett said that her horse was travelling well and the other horses around her were not travelling as well. She said that when she moved, the rider of ARTIC MISS tried to chase his horse up and this did not help the situation.

She did acknowledge that she came out too quickly.

Submissions for Penalty:

Mr Jones said that the level of carelessness was mid range and the consequences were on the lower side. He did say that this was Miss Collett's 4th breach of the Rule in the last 12 months. She had breaches of the Rule on the 29th December 2016 (4 days suspension imposed ) 21st of January 2017 (5 days suspension imposed ) and 22nd February 2017 (4 days suspension imposed ).

Mr Jones said Miss Collett was a busy rider and that she rode all over the Country.

Miss Collett said that although she had had the 3 breaches of the Rule mentioned by Mr Jones she had had approximately 800 rides during that period and she was a National Rider.

Miss Collett also asked for a deferment of any suspension until after the Counties RC  meeting on the 24th of September 2017.

Reasons for Penalty:

The Committee listened to the parties and carefully viewed the films of the incident. It is very clear that not only did Miss Collett move out when not sufficiently clear of ARTIC MISS but that she did cause a check to that horse. It was also clear that Miss Collett's horse was travelling better than the others around it.

The aggravating feature is Miss Collett's record although that has to be considered in relation to the number of rides she has had in that period. We condider her record to be a neutral factor. We recognise that she is a National Rider.

In mitigation she has admitted the breach and we consider the level of carelessness to be low and the consequences of that carelessness to be minimal. The starting point penalty for careless riding is a 5 day suspension but taking into account the mitigating factors we have reduced that by one day. The suspension will be one of 4 days.

We grant Miss Collett's request for a deferment of her suspension until the conclusion of racing at the Counties Racing Club's meeting on the 24th of September 2017.
