Facts:
Prior to the running of race 10, Munns The Man Store, an Information was filed pursuant to Rule 330(3)(c). The Informant, Mr Oatham, alleged that Mr McNab was unable to make the contracted weight for TAVIS STAR.
Mr McNab admitted the breach and advised the Committee that he did not wish to be present at the hearing and endorsed the Information accordingly.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Oatham advised that Mr McNab was unable to make the contracted weight for TAVIS STAR and was replaced by Mr McKay.

Mr Oatham said that Mr McNab had breached this Rule in February and May this year where he was fined the sum of $100 and $200 respectively under the Minor Infringement System. He submitted a fine of $300 would be appropriate for today’s breach.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
Mr McNab was served with an Information because he failed to make the contracted weight for the third time within a 120 day period.
The Committee had regard for other similar breaches of this Rule when determining an appropriate and consistent penalty.
