Accordingly after taking all the above into account we impose a suspension on Mr Nolan from riding in races which is to start after racing today 2 October and conclude after racing on 9 October 2011 (4 riding days).

Facts:
Following race 3 the informant Mr A Coles alleged that Mr D Nolan permitted his mount to shift inwards near the 800 metres when not sufficiently clear of ACE HIGH (H Kasim) which was checked.
Submissions for Decision:
Mr Oatham demonstrated the video films and pointed out JAFFA JACK ridden by Mr Nolan racing in a 3 wide position approaching the bend at the 800 metres. Mr Oatham said Mr Nolan then allowed JAFFA JACK to move in when only 1/2 to 3/4 length clear of ACE HIGH which caused its rider Mr Kasim to check and lose momentum. He conceded Mr Nolan immediately relieved the pressure when he realised his mistake but it was a little late.
Mr Nolan, in admitting the charge, said he moved in for 1 stride then pulled off at the first opportunity. He acknowledged that he caused a check to Mr Kasim.

Mr Nolan said he did not have any upcoming commitments.

The committee carefully considered all the evidence and submissions as presented. In Mr Nolan's favour are his admission of the breach and his good record. The aggravating factor is the check received by Mr Kasim through the inward movement of Mr Nolan when insufficiently clear. However because Mr Nolan took immediate action we find his carelessness at the low end of the scale.
