As the breach was admitted we find the charge proved.
Penalty:
After taking all the above factors into account we impose a suspension on Mr Forbes from riding in races which is to start after racing on 9 October and conclude after racing on 19 October 2011 (4 days). This deferment of penalty comes pursuant to rule 1106 (2 a).

Facts:
Following race 10 an information was filed pursuant to rule 638 (1) (d). The informant Mr Coles alleged that Mr A Forbes permitted his mount INSURGENT to shift outwards near the 400 metres hampering ZABISCO ( M Coleman).
Submissions for Decision:
Mr Oatham demonstrated the video films which showed INSURGENT ridden by Mr A Forbes racing in a position 2 from the outside soon after turning for home. It was then evident on the films that Mr Forbes allowed his mount to move out approximately 3 horse widths forcing ZABISCO out over considerable extra ground. Mr Oatham said Mr Forbes continued to ride aggressively with the whip when he should have stopped and straightened his mount.
Mr A Forbes said Miss D Johnson who was on his inside had moved out contributing to the incident.
Mr G Forbes said the speed of the track and the inexperience of Mr A Forbes were factors in the interference.

Mr Coles said the interference received by ZABISCO which was the favourite, could well have cost it the race as it ran on strongly for second after the interference it had suffered. However he submitted a suspension at the low end of the scale would be appropriate.
Mr G Forbes said that Mr A Forbes had future commitments up to and including the Waipa meeting on 9 October 2011.

The committee carefully considered all submissions and evidence. In Mr Forbes favour are his admission of the breach and this was his first charge. However in this case his inexperience caused him to make the mistake of continuing to ride with the whip while on an outward movement when insufficiently clear of ZABISCO. The committee is nevertheless satisfied that Mr Forbes carelessness was at the low end of the scale.
