Accordingly after taking all the above factors into account we impose a fine of $250.

Facts:

Following Race 4 Mr J Oatham alleged that Miss M Vance wore her safety vest in an incorrect manner (inside out) in contravention of a directive.

Submissions for Decision:

Mr Oatham explained to the committee that it is the responsibility of all riders to wear their body protecters in a correct manner.  He said tests had been carried out showing them to be much more effective if worn the proper way and not inside out.  Mr Oatham said Miss Vance had been warned on previous occasions that she must wear her vest in the correct way.

Miss Vance said she had been rushing and just added her vest incorrectly.

Submissions for Penalty:

Mr Oatham said that this was Miss Vance's first charge for this type of offence.  However he said it was important that a clear message be sent to all riders that wearing safety vests incorrectly was unacceptable.  The rule was in place for the safety of all riders.  He submitted a fine of $200 - $300 would be appropriate.

Miss Vance had nothing to say regarding penalty.

Reasons for Penalty:

The committee considered all submissions before imposing an appropriate penalty.  Mitigating factors are Miss Vance's admission of the breach and that this was her first offence under this rule.  However the aggravating factor is that she had been warned previously that she  must wear her vest correctly.
