Following Race 9 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Stipendiary Steward Mr AR Coles, that Mr MJ Williamson, rider of UNIVERSAL CHARM committed a breach of that rule

DECISION AND REASONS:

Following Race 9 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Stipendiary Steward Mr AR Coles, that Mr MJ Williamson, rider of UNIVERSAL CHARM committed a breach of that rule when he angled his mount UNIVERSAL CHARM outward when not the required distance clear of LET?S ENJOY (D Hain) who clipped a heel of UNIVERSAL CHARM.

Mr Williamson did not admit the offence.

Mr Coles firstly asked Mr D Hain, rider of LET?S ENJOY if he had suffered any interference. Mr Hain said that when he rounded the bend into the home straight Mr Williamson's mount rolled out half to one horse width and took his line. Mr Coles added that he thought the distance was greater than that stated by Mr Hain.

Mr Oatham demonstrated the films in which he showed UNIVERSAL CHARM making ground as it entered the straight. As they straightened up he showed the outward movement of UNIVERSAL CHARM and the subsequent check to Mr Hain's mount LET?S ENJOY. He pointed out the movement of CANDACE ridden by Miss Woods but felt that it did not contribute to the interference.

Mr Williamson pointed out the movement of CANDACE and then claimed that a more experienced rider than Mr Hain would have grabbed hold of his mount to avoid the interference, which occurred.

The Committee viewed the films again and considered the evidence of all parties. It is of the opinion that although CANDACE has moved out a little, the side-on film shows that she was clear of other horses.

Mr Williamson admitted that Mr Hain, if more experienced, may have grabbed hold of his mount and negated any interference. Mr Hain had no obligation to do this and we therefore find Mr Williamson guilty as charged as we are in no doubt that he angled his mount out and took Mr Hain's line, causing the clipping of heels.

Mr Coles gave Mr Williamson's very good record but asked for a suspension.

Mr Williamson asked that his future riding engagements be taken into account.

The Committee after taking all matters including Mr Williamson's good record into account suspends him from the conclusion of racing on the 5 March 2005 until the conclusion of racing on the 14 March 2005.
