This is a protest lodged by A Coles, Stipendiary Steward, alleging interference by COUNT ZOHRA ridden by M Sweeney placed third by the Judge affecting the chances of AUTUMN STAR ridden by B R Jones placed fourth by the Judge in respect of the Stanley Bros/Allan Sharrock 1600 on 2.4.05 at Te Rapa. The Judge's placings and the margins were:

The protest was lodged pursuant to Rule 876(1) and seeks relegation of COUNT ZOHRA. It was lodged in accordance with rule 1107(2) within two minutes of the last to be weighed in of the riders of the horses placed by the Judge being weighed in.

The first question which we are required to consider is whether:

--

AUTUMN STAR was interfered with and whether COUNT ZOHRA caused that interference as alleged.

--

The Committee heard evidence from Mr J Oatham, Stipendiary Steward. He gave evidence and demonstrated the incident on the race video head-on and side-on. Mr Oatham said that COUNT ZOHRA ridden by M Sweeney hampered AUTUMN STAR ridden by B R Jones.

Mr Sweeney's mount moved out 3 horse widths hampering AUTUMN STAR. As a consequence of the interference AUTUMN STAR lost momentum at a critical stage of the race. Mr Oatham emphasized the strong finish of AUTUMN STAR. Mr Jones, rider of AUTUMN STAR, confirmed Mr Oatham's observation. He said his horse came from behind and finished strongly. He said his horse's line was dictated and he was denied an opportunity. He stated that his horse would have finished third had it not been for the interference.

Mr Sweeney gave evidence. He did not challenge the informant's evidence. He said that his horse lost momentum in the incident.

We prefer the informant's evidence. We are satisfied that interference occurred. It is then necessary for us to consider whether that interference interfered with the chances of AUTUMN STAR. It is relevant to this consideration that AUTUMN STAR was taken out 3 horse widths, lost momentum at a critical stage, made ground strongly and the official margin of half a length between third and fourth.

Hence we find the chances of AUTUMN STAR were interfered with by the interference of COUNT ZOHRA.

--

We now have a discretion whether or not to place COUNT ZOHRA behind AUTUMN STAR. It is therefore our considered opinion that COUNT ZOHRA should be relegated. The placings are now:
